Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the TicketsData website at ticketsdata.live, the TicketsData API and related services (together, the “Service”), provided by TicketsData (“TicketsData”, “we”, “us”).

By creating an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization. If you do not agree, do not use the Service.

2. The Service

TicketsData provides data about live events and ticket listings — such as listings, prices, availability, venue information and seat maps — gathered from third-party ticket marketplaces and normalized into one format, together with tools to search, capture and compare that data.

We do not sell tickets, are not a party to any ticket purchase, and are not affiliated with, endorsed by or sponsored by any marketplace. Marketplace names and logos are trademarks of their respective owners and are used only to identify where data comes from.

We may add, change or remove features and supported marketplaces at any time. When we make a change that breaks existing API integrations, we will try to give reasonable notice.

3. Your account

To use live data you need an account with a verified email address and a paid plan. You agree to:

give accurate information and keep it up to date;

be at least 18 years old, or the age of majority where you live;

keep your password and API key secret — each account has one API key, and anyone who has it can use your plan;

tell us promptly at support@ticketsdata.live if you think your account or key has been compromised;

take responsibility for all activity under your account and API key.

4. Plans, requests and billing

Paid plans are monthly subscriptions at a fixed price shown on our pricing page. Each plan includes an allowance of requests per month and per hour. A capture uses one request, an event search uses one request per marketplace that returns results, and a match uses three requests. Failed requests are not counted. Unused requests do not roll over.

Subscriptions are billed in advance by card through our payment processor, Stripe, and renew automatically each month until cancelled. You can upgrade, downgrade or cancel at any time from the billing page of your dashboard. Upgrades take effect immediately and are prorated; cancellations take effect at the end of the current billing period, and you keep your plan until then.

Fees are non-refundable, including for partial months and unused requests, except where the law requires otherwise. We may change prices with at least 30 days’ notice by email; the new price applies from your next billing period. Prices do not include taxes, which you are responsible for where they apply.

If a payment fails, we may retry it and, if it is not settled, downgrade or suspend your account.

5. Acceptable use

You may use the data in your own products, services and internal analysis. You agree not to:

use the Service for anything unlawful, including in breach of ticket-resale, consumer-protection or data-protection laws;

share, sell or publish your API key, or let anyone outside your organization use your account;

create multiple accounts, use the playground or any other means to get around plan limits, rate limits or payment;

resell, sublicense or redistribute the data as a raw or bulk feed, or use it to build a service that competes with TicketsData;

probe, scan or test the security of the Service, or reverse engineer it, except as the law expressly allows;

interfere with or overload the Service, or access it by any means other than the API and website we provide;

remove or misrepresent where the data comes from.

6. Data accuracy

Ticket prices and availability change constantly and come from third parties. Data may be delayed, incomplete or inaccurate, and a marketplace may change or withdraw its data at any time. You are responsible for checking information before relying on it, and for any decision you make — including any purchase or sale — based on it.

7. Privacy

Our Privacy Policy explains what personal information we collect and how we use it. It forms part of these Terms.

8. Availability

We work to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free, and we do not offer a service-level agreement unless we have agreed one with you in writing. We may carry out maintenance, and marketplaces may be temporarily unavailable.

9. Suspension and termination

We may suspend or close your account, or revoke your API key, if you breach these Terms, do not pay, put the Service or other users at risk, or if the law requires it. Where reasonable we will tell you first.

You can stop using the Service at any time and ask us to close your account by writing to support@ticketsdata.live. Sections 6 and 10 to 14 continue to apply after your account ends.

10. Intellectual property

The Service, including its software, documentation, design and the way data is structured and normalized, belongs to TicketsData and its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active and in line with these Terms. If you send us feedback, we may use it without any obligation to you.

11. Disclaimers

The Service and all data are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

12. Limitation of liability

To the fullest extent the law allows, TicketsData will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to defend and indemnify TicketsData against any claims, losses and costs (including reasonable legal fees) arising from your use of the Service in breach of these Terms or of the law.

14. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. The state and federal courts located in New York County, New York have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you and we consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. If a change is material, we will tell you by email or on the website before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
